What the enforcement regulation establishes
8 CFR 287.8 addresses immigration questioning, brief detention, arrests and site inspections. It requires a factual basis for an arrest and generally calls for an arrest warrant, with an exception when the designated officer has reason to believe the person is likely to escape before a warrant can be obtained. The regulation is not a blanket authorization for every arrest.
Apply the source to the actual facts
Preserve the notices, custody records and other documents relevant to the person’s identity and immigration history. A lawyer can assess the legal basis of the detention and the available procedure for review. This article does not determine that a particular arrest was unlawful or guarantee release.
An administrative immigration process and a criminal prosecution are different. The applicable rights and review procedures depend on the case. No statistical trend or new naturalization, visa, or employment policy is established by this general enforcement source.
