Correction: We have withdrawn the earlier claim that a new federal rule automatically waives marriage-based adjustment interviews. The cited announcements did not substantiate that claim.

What the interview regulation says

Under 8 CFR 245.6, an adjustment applicant generally must be interviewed. The regulation permits USCIS to waive an interview when the agency determines that it is unnecessary. A waiver is an agency decision; filing a particular set of documents does not guarantee one.

Prepare the full application

Applicants still need to establish eligibility for adjustment and the underlying petition. Marriage alone does not resolve admission, admissibility, visa availability, or other requirements. Keep evidence of the relationship and follow the current form instructions and any request for evidence.

If USCIS schedules an interview

Follow the appointment notice and prepare to answer accurately about the application and relationship. Do not disregard an interview notice because another couple received a waiver. This article makes no promise of faster approval or a fixed processing time.
