Correction: We have withdrawn the unverified Los Angeles emergency account, detention totals and nationwide trend claims in the earlier version. General enforcement rules do not establish that a particular raid or emergency declaration occurred.
What the enforcement regulation establishes
8 CFR 287.8 addresses immigration questioning, brief detention, arrests and site inspections. It requires a factual basis for an arrest and generally calls for an arrest warrant, with an exception when the designated officer has reason to believe the person is likely to escape before a warrant can be obtained. The regulation is not a blanket authorization for every arrest.
Apply the source to the actual facts
The regulation distinguishes inspections of nonpublic premises from access to public business areas and addresses consent and warrants. Application depends on the setting and facts. Obtain individual legal advice about a specific encounter and retain any documents provided by officers.
An administrative immigration process and a criminal prosecution are different. The applicable rights and review procedures depend on the case. No statistical trend or new naturalization, visa, or employment policy is established by this general enforcement source.
