Correction: We have withdrawn the unverified account of a particular Chicago release order and the number of people it covered. A general enforcement regulation is not evidence that a specific court entered that order.
What the enforcement regulation establishes
8 CFR 287.8 addresses immigration questioning, brief detention, arrests and site inspections. It requires a factual basis for an arrest and generally calls for an arrest warrant, with an exception when the designated officer has reason to believe the person is likely to escape before a warrant can be obtained. The regulation is not a blanket authorization for every arrest.
Apply the source to the actual facts
Reading a regulation does not establish the result of a court case. To assess a claimed ruling, obtain the court, docket, order date and actual order, including any limits on who is covered.
An administrative immigration process and a criminal prosecution are different. The applicable rights and review procedures depend on the case. No statistical trend or new naturalization, visa, or employment policy is established by this general enforcement source.
