Correction: We have removed the unsupported population-growth citation and unverified assertions about arrest quotas and local detention increases. An appointment notice does not establish whether detention will occur in an individual case.
What the enforcement regulation establishes
8 CFR 287.8 addresses immigration questioning, brief detention, arrests and site inspections. It requires a factual basis for an arrest and generally calls for an arrest warrant, with an exception when the designated officer has reason to believe the person is likely to escape before a warrant can be obtained. The regulation is not a blanket authorization for every arrest.
