The Department of Homeland Security (DHS) has proposed an adjustment of certain USCIS immigrant fees applied to immigration and naturalization benefits granted by the immigration agency.  The fees had remained unchanged since 2016.

However, this new increase in the fees applied to the general immigration and naturalization forms will not be effective immediately. The proposed new USCIS fees will be blocked for two months, subject to public comment. 

After that time, the agency will make a final decision on the fees to be applied.

    What are the proposed new USCIS immigrant fees?

    As part of the annual report submitted by USCIS, a comprehensive review of immigrant visa fees was conducted in 2022. It determined that by maintaining current costs, the agency is far from recovering the full value of operations

    It is for this reason that the Department of Homeland Security has proposed an increase in immigration fees. The measure seeks to recover operating costs in order to allow for an increase in immigration staff and salaries.

    If the initiative is successful, it will streamline the immigration process and increase its functionality to its highest capacity.

    What will be the raise in USCIS immigrant fees?

    The first thing we need to know about the new values is that not all fees will be affected. The proposed rule affects only certain cases of immigrant visa fees. Others, in fact, will see a reduction in their costs.

    In addition, the existing exemption for low-income and vulnerable populations will be preserved. Furthermore, it would be extended to more humanitarian programs that currently pay USCIS immigrant fees.

    Currently, the new immigration fees are blocked, pending public comments. If made effective, the change would affect more than one million low-income taxpayers each year.

    When do USCIS immigrant fees change? 

    The change in immigrant visa fees will not be implemented soon. The process to implement the change consists of several steps. The new rates will not be effective for at least two months.

    At present, the new USCIS immigrant fees are locked in. Before becoming effective, they must pass public scrutiny. 

    Now that the proposal has been made, the next step is a 60-day period during which, immigrants and other citizens will be able to give their opinion on the new values. USCIS will consider the comments and decide on implementation after this window. 

    Changes in USCIS Immigrant Fees

    If the new proposed rule is adopted, some of the most common immigrant visa fee procedures will be affected. In the list provided by the government, the intention to promote the online application is distinguished. 

    For this reason, this type of presentation is the least affected. And the fee varies whether the form is submitted online or physically, and whether or not an appointment must be scheduled for fingerprinting. 

    The most significant USCIS immigrant fees that would be affected by the increase in values are: 

    • N-400 – Application for Naturalization: the costs for U.S. citizenship will increase from 35 to 120, going from 640 to 760 for paper filing and from 725 to 760 for online filing. 
    • N-600 – Application for Certification of Citizenship: the cost of U.S. citizenship through certification will increase from 1,170 to 1,385, registering an increase of 215. The modification affects both online and paper procedures. 
    • I-130 – Petition for Alien Relative: an increase of between 175 and 285 is contemplated, going from 535 to 710 if the process is done online and 820 if it is on paper.
    • I-765 – Application for Employment Authorization: an increase of between 60 and 155 are contemplated, depending on the modality. Going from 495 to 555 for the online form and 650 if it is on paper. 
    • I-601A – Application for Provisional Unlawful Presence Waiver: the increase will be 475. Going from 630 to 1,105.
    • I-751 – Petition to Remove Conditions on Residence: the cost will have a growth of $600, going from $595 to $1,195.

    How to avoid the new USCIS immigrant fee increases?

    It is always a good time to start the immigration process and move on to receive the benefits of legal residency. However, with the immigration fee increase coming soon, this is a good time to make sure to save some money and start the process in the next 2 months
